Life Insurance Incontestable Clause, Part 4
Sometimes life insurance companies will tack on two extra amendments to this provision. They are:
a. "except to any provision relating to benefits in the event of total and permanent disability" b. "except as to any provision relating to benefit by reason of death by accidental means"
Life insurance companies include these in their provisions so that they have some legal rights when the claim is for a total disability or double indemnity one. Insurance companies still use these amendments regardless of the fact that sometimes these clauses don't work, and life insurance companies end up losing money because they can't make any contest against any claim, other than what's stated in their provisions. A lot of tricky legalities, aren't there?
